Bongaon PS Case No. 179/2007 dt. 04/04/2007 u/s 419/ 420/ 468/ 469/ 470/ 471/ 121/ 121A/ 122/ 124A/ 120B IPC and Section 14 of the Foreigner's Act.ST No. 03(05)08, SC No. 17(09)07, GR No. 278/07 On 01/04/2007, two Pakistani nationals namely Md. Younus and Md. Abdulla accompanied by two Indians namely Muzaffar Ahmed Rathor and Nayeem @ Sk. Sameer were entering into India in a clandestine way through Petrapole, Bongaon along Indo-Bangladesh border without any valid documents and were carrying US Dollars, mobile phones. They were destined to go to J & K to waging war against India being instigated by the let ISI of Pakistan. They were caught by the BSF personnel on duty. This referes to Bongaon PS Case No. 179/2007 dt. 04/04/2007 u/s 419/ 420/ 468/ 469/ 470/ 471/ 121/ 121A/ 122/ 124A/ 120B IPC and Section 14 of the Foreigner's Act. The case was investigated by CID, WB. During PC of the accused persons, further incriminating articles including one card board box 12" x 10" x 6" containing sticky material called "NITROGLYCERINE"- which is a special category of explosive substance. After investigation Charge-Sheet was submitted. After Trial of the case all the 04 accd. persons were convicted. The accused persons moved the Hon’ble High Court Calcutta wherein the Hon’ble Court had passed the judgement on 14/11/22 that the death sentence and the fine of Rs 50,000 each imposed on the appellants are set aside. Against the judgement of the Hon’ble High Court Calcutta, the State Government of West Bnegal moved the Apex court wherein the Apex court has stayed the judgement of the Hon’ble High Court Calcutta.
